Terms and Conditions

1. Some of the terms you will find here have a very specific meaning.

A2. About these conditions

1. By completing your Reservation, you are accepting these Conditions and any other provisions that have been provided to you during the reservation process.

2. If any provision of these Conditions is (or becomes) invalid or unenforceable:

it will continue to be in force to the fullest extent permitted by law;

you will remain bound by the rest of the provisions of the Conditions.

3. These Conditions are structured as follows:
Section A: general terms, for all types of mooring reservations.

Section B to C: specific terms, for only one type of trip:

Section B: Moorings

Section C: Contracting of Port services

In the event of a discrepancy between the general and specific terms, the specific terms will prevail.

A3. About Search Marina S.L

1. When you book a mooring or Search Marina S.Les service, you are the provider and the person responsible for the Platform, but not for the Travel Experience itself (see section A4.4).

2. We work with companies that offer local support services (for example, Customer Service or account management). They do not: control or manage our Platform;

they have their own platform;

formalize a legal or contractual relationship with you;

they offer travel experiences;

represent us, enter into contracts or accept legal documents on our behalf;

they operate as our “service or process agents.”

A4. Our Platform

1. We take reasonable precautions when offering our Platform, but we cannot guarantee that all content is accurate (we obtain the information from Service Providers). To the extent permitted by law, we will not be responsible for any errors, interruptions or missing information, although we will do our best to correct and remedy these as quickly as possible.

2. Our Platform does not imply the recommendation or approval of any Service Provider or its products, services, facilities, vehicles, etc.

3. We are not part of the agreement of conditions that you and the Service Provider sign, and the latter is solely responsible for the Travel Experience.

4. You may need to create an Account to make a Reservation. Please ensure that all information (including payment and contact details) is correct and up-to-date, or you may not be able to access your Travel Experiences. You are solely responsible for everything that happens with your Account, so you must prevent anyone else from using it and you must keep your username and password secret.

5. We will show you the offers that are available to you in the language (that we think is) suitable for you. However, you can change it at any time.

6. Unless otherwise stated, you must be at least 18 years of age to use the Platform.

A5. Our values

1. You agree to:

comply with all applicable laws;

Cooperate in any anti-fraud/anti-money laundering checks we need to carry out;

not to use the Platform to cause damage or make false Reservations;

use the Travel Experience and/or our Platform for its intended purpose;

not to cause harm or damage and not to behave inappropriately towards the Service Provider’s staff (or anyone, for that matter).

A6. Prices

1. When you make a Reservation, you agree to pay the cost of the Travel Experience, including all fees and taxes that may apply.

2. Some of the prices you see may have been rounded to the nearest whole number. The price you pay will be based on the original price, not the rounded one (although the actual difference between the two will be minimal).

3. Obvious errors and misprints are not binding. For example, if you reserve a service or a mooring that was offered by mistake at €1 or a price that did not correspond to the usual rate of the port, except for some implicit discount or a high price due to seasonality, we can simply cancel the Reservation and refund you. any amount you have paid.

4. A crossed-out price indicates the price of an equivalent Reservation without the price reduction applied (“equivalent” means same dates, same conditions, same quality of accommodation/car/travel class, etc.).

A7. Pay

1. For some products and services, the Service Provider may require an Advance Payment and/or a payment made during the Travel Experience.

If we handle the payment, we (or sometimes our affiliate in the country of origin of the payment) will be responsible for handling the payment and ensuring that the transaction is completed with the Service Provider. In this case, the payment you make constitutes the final settlement of the “due and payable” price.

If the Service Provider is in charge of charging you, they will generally do so in person at the start of your Travel Experience, but it could also be done, for example, through the credit card at the time of booking or at the time of from the check-out of the Accommodation. This depends on the Service Provider’s Advance Payment terms communicated to you during the booking process.

2. If the Service Provider requires a Prepayment, it may be collected or pre-authorized at the time of Booking and may be non-refundable. Therefore, before making a reservation, check the Service Provider’s Prepayment conditions (available to you during the reservation process), over which we have no influence and for which we are not responsible.

3. If you become aware of or suspect that fraud or unauthorized use of your Payment Method has occurred, please contact your payment provider who may cover the costs resulting from such fraud or misuse, possibly subject to to a franchise.

4. If the currency selected on the Platform is not the same as that of the Service Provider, we may (When operationalized):

display prices in the currency of your choice;

Offer you the option to pay in your currency.

You will be able to see our Currency Exchange Rate during the payment process, in the information of your Reservation from your Account or, if you do not have an Account, in the e-mail that we have sent you. If we charge you a fee in connection with any of these services, you will find that fee expressed as a percentage of European Central Bank rates. Your card issuer may charge you a foreign transaction fee.

5. We will store the data of your Payment Method for future transactions once the terms and conditions are accepted. In case you do not want them to remain saved or you want to modify them, you can carry out the operation in the application.

6. In the event that payments are made with cards from abroad, such as American Express or cards that are in charge of an established company, a second charge will be made, applying the corresponding commissions to that type of card.

A8. Conditions

1. When you make a Reservation, you are accepting the applicable conditions that are displayed during the reservation process. You will find the cancellation conditions of the Service Providers, as well as any other conditions (age requirements, deposits for damages/security, additional supplements for Group Reservations, extra beds, breakfast, pets, accepted cards, etc.), in our Platform: on the information page of the Service Provider, during the reservation process, in the “To take into account” section and/or in the confirmation or ticket e-mail (if applicable).

2. If you cancel a Reservation or no-show, the cancellation or no-show charges, as well as any refund, will depend on the cancellation and no-show conditions of the Service Provider.

3. Some Reservations cannot be canceled for free, while others can only be canceled free of charge before a certain period.

4. If you book a Travel Experience by paying in advance (including all price components and/or a damage deposit, if applicable), the Service Provider may cancel the Reservation without prior notice if it is unable to collect the balance in the specified date. If so, any non-refundable payments you have made will be refunded at your sole discretion. It is your responsibility to ensure that the payment arrives on time (that your bank, debit card or credit card information is correct and that you have sufficient funds in your account).

5. If you think you will not arrive on time, please contact the Service Provider and let them know when you will be able to arrive so that they do not cancel the Reservation. If you arrive late, we will not be held responsible for any consequences such as cancellation of the Booking or any charges that the Service Provider may charge you.

6. As the person making the Booking, you are responsible for the actions and behavior (in relation to the Travel Experience) of each person in your group. You are also responsible for obtaining their permission before providing us with their personal data.

about our Platform and/or our services, contact our Customer Service team; about your Travel Experience (access for wheelchairs, bathtubs with a door, etc.), contact the Service Provider, port, etc.

A11. insurance

1. If you have purchased any insurance through our Platform, please refer to the policy documents for the terms and additional information. These Conditions do not apply to insurance.
